ARTICLE 1: Purpose

These General Terms and Conditions of Sale govern the contractual relationship between Aura by Emma Zepter and its customer, both parties accepting them without reservation. They apply to all orders. These contractual provisions set out the rights and obligations of the company and its co-contracting party in the context of distance selling of the goods offered on the website emmazepter.com. They prevail over any other conditions contained in any other document, unless there is a prior, express and written derogation. They apply in France and abroad.

ARTICLE 2: Online purchase / validation

No banking data you provide transits through or is stored on our site. Online payment is made directly on our banking partner’s website.

ARTICLE 5: Prices

The price shown on the site is final. It is indicated in euros. The seller may modify its prices at any time. The prices indicated are established on the basis of the economic conditions in force. Should these conditions change for any reason whatsoever (taxes, exchange rates, etc.), the invoiced prices may vary in line with such changes.
Prices will be invoiced including all taxes (TTC) on the basis of the rates in force at the time the order is placed. emmazepter.com cannot under any circumstances be held responsible for any additional costs arising from customs duties.

ARTICLE 6: Transport and inspection of goods

The seller is free to choose the carrier. The seller undertakes to deliver the products ordered to the address indicated by the buyer within 5 days of acceptance of the order for deliveries within the EU, and 10 days for other countries. In the event of a delay in delivery of more than seven days not due to force majeure, the buyer may rescind the contract under the conditions of Article L 114-1 of the French Consumer Code, i.e. by registered letter with acknowledgement of receipt, within sixty working days from the date originally indicated for delivery. If the recipient or a person able to take possession of the products is absent, the carrier will leave a delivery notice indicating where the products can be collected. The seller cannot be held to the obligation of dispatch or delivery in cases of force majeure, including but not limited to total or partial strike, natural disasters, or loss/damage. Any case of force majeure, or presenting the characteristics of force majeure, constitutes grounds for extinguishing the obligations of dispatch and delivery, without any compensation being due to the buyer.

ARTICLE 7: Transfer of title

Transfer of ownership of the goods delivered or to be delivered is suspended until full payment of the price by the buyer. The seller remains the owner of the products until payment has been made in full.

ARTICLE 8: Returns, refunds, right of withdrawal

Return of products: Reservations may be made upon delivery only in the event of a delivery quantitatively non-compliant with the order or when the packaging containing the products has been severely damaged. Reservations must be made with the carrier upon delivery or, at the latest, within 72 hours after delivery to the carrier. A copy of these reservations must be sent to the seller within 24 hours of delivery, either by e-mail or by fax. This communication must include the carrier’s confirmation of the reservations, the reason for return, and the invoice number concerned. If the products have been severely damaged, the company reserves the right either to refund the price paid or to replace the damaged item or batch. Right of withdrawal: The buyer may withdraw from the contract in accordance with Article 121-16 of the French Consumer Code. The buyer has a period of 14 working days from delivery of the order to return the product to the seller for an exchange or refund without penalty, except for return shipping costs. For information, average return costs are €10 for France and €15 for other countries. If the buyer exercises this right of withdrawal, they are responsible for organizing and paying for the return. The product must be returned in its original packaging, intact, unopened, i.e. with the original cellophane seal, for hygiene reasons, and accompanied by all accessories, user manuals and documentation, if any. The buyer may request any information by e-mail, fax or telephone. Refunds: Any refund will be made by bank transfer.

ARTICLE 9: Intellectual property

All texts, comments, works, illustrations and images reproduced on the seller’s websites are protected by copyright and intellectual property rights worldwide. In accordance with the provisions of the French Intellectual Property Code, only use for private purposes is permitted (subject to different or more restrictive provisions of the Code). Any other use constitutes infringement and is punishable under intellectual property law, unless prior authorization has been obtained from the company. Any total or partial reproduction of the catalogue is strictly prohibited.

ARTICLE 10: Governing law and disputes

This contract is governed by French law. The language of this contract is French. In the event of a dispute, the French courts shall have exclusive jurisdiction.

ARTICLE 11: Personal data

The seller undertakes not to disclose to third parties the information you provide to us. Such information is confidential. It will be used only by our internal services for processing your order and to enhance and personalize communication and the cultural/product offer reserved for our customers. In accordance with the French Data Protection Act of 06/01/1978, you have the right to access, rectify and object to personal data concerning you. To exercise this right, simply send us a request online or by post, indicating your first name, last name and address.
